Lit Fiber Broadband Transparency Disclosure

This disclosure describes information about our network management practices and commercial terms consistent with the Federal Communications Commission’s (“FCC’s”) Transparency Rule regarding our broadband services (“Services”). 

Nothing in this disclosure changes your rights and obligations, or ours, under our Service Terms, Terms of Use, and Privacy Policy. This disclosure is provided for informational purposes only and we may change the information at any time, without notice.

Network Practices

Temporary congestion may occur when a large number of customers in a concentrated area try to access our network simultaneously or when some customers consume a large amount of network capacity during busy periods, peak usage times, or planned network maintenance. We connect to a larger part of the Internet consisting of multiple interconnected networks. We must connect to and exchange traffic with other networks to provide our customers the capability of uploading data to or downloading data from Internet endpoints connected to those networks. We have no control over Internet traffic in general.

During periods of congestion, we or other providers on the Internet may experience reduced data speeds and increased latency. Reduced speeds and increased latency may cause websites to load more slowly or affect the performance of data-heavy activities such as video streaming or interactive gaming. Such an impact will last only as long as the Internet networks are congested. We endeavor to keep any congestion to a minimum. However, we may take steps to control traffic congestion to ensure that all our users have access to the Services.

Network Speed

We have speed tiers for our Broadband Services so that our customers can choose from a variety of speed tiers or rate plans that best reflect their own usage levels, and the manner in which they intend to use their service.  In other words, certain customers on different price plans may obtain higher speeds than customers on other plans.  

Data Usage

At this time, we do not restrict users to the amount of data they use per month based on their plan. 

We do not throttle users or favor specific providers

We do not favor certain websites or Internet applications by blocking or throttling lawful internet traffic on the basis of content, application, service, user, or use of non-harmful devices on our Services. We do not directly or indirectly favor some traffic over other traffic (such as through prioritization, resource reservation, or traffic shaping) for any type of consideration. In response to a specific security threat against our networks,  we may occasionally need to limit the flow of traffic from certain locations or take other appropriate actions. Also, emergency communications, law enforcement, public safety, or national security authorities, may have priority on our networks consistent with or as permitted by applicable law.

Copyright Infringement

We will take action to respond to alleged copyright infringement activities, including unlawful peer-to-peer file sharing  of copyright material. Under the United States Digital Millennium Copyright Act (“DMCA”), content owners may notify us of alleged copyright infringement based on the IP address of a user. We will respond to such notices under the procedures required by the DMCA and detailed in the Lit Fiber DMCA Copyright Infringement Policy located at https://www.lit-fiber.com/dmca. This may result in us taking down or requesting users to take down content in compliance with the DMCA and our policy. Please review your rights and obligations at  https://www.lit-fiber.com/dmca  if we notify you of a claim for infringement. Please note that we have the right to terminate your account for repeated copyright offenses. 

Security

We have implemented measures designed to secure your personal information from accidental loss and unauthorized access, use, alteration, and disclosure, including the use of firewalls, multi-factor authentication and encryption of personal data. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.  Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Broadband Services. Any transmission of personal information is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures by you. 

We don’t restrict devices

We do not restrict the type of lawful devices you can use to connect with our Services provided that it is compatible with connecting to our Services, whether you access the services by desktops, laptops, tablets or other devices. 

Commercial Terms

Your use of our Services are subject to Lit Fiber’s Service Terms and Terms of Use. Descriptions of the prices and fees applicable to our Services are available on our website. For more information, please review our rate and data plan information at https://www.lit-fiber.com/my/medina. We do not charge termination fees.
